𝗖𝗵𝗶𝗻𝗮 𝗣𝗿𝗼𝗽𝗼𝘀𝗲𝘀 𝗦𝗶𝗴𝗻𝗶𝗳𝗶𝗰𝗮𝗻𝘁 𝗨𝗽𝗱𝗮𝘁𝗲𝘀 𝘁𝗼 𝗧𝗿𝗮𝗱𝗲𝗺𝗮𝗿𝗸 𝗟𝗮𝘄

The China National Intellectual Property Administration (“CNIPA”) launched a public consultation on draft amendments (the “Draft”) to the PRC Trademark Law. The Draft proposes major changes to the PRC Trademark Law, primarily tackling China’s overcrowded trademark register and bad faith filings as well as enhancing the efficiency of the trademark system. The proposed changes in the Draft, if accepted, will significantly impact brand owners’ filing, portfolio management and enforcement strategies.

Upon monitoring the further developments and final amendments that will be enacted, brand owners are recommended to review and adjust their approach to IP protection in China.
