It is indeed quite rare for the Hong Kong courts to refuse enforcement of an arbitral award, and our Dispute and Resolution Partner, Simon Wong has written an article discussing a recent case where the Hong Kong Court of First Instance set aside an ex-parte Order granting leave to enforce an arbitral award made by the Zhanjiang Arbitration Commission in China. Madam Justice Mimmie Chan observed that it would be “shocking to the conscience of the Court” to permit the award to be enforced in Hong Kong.
