Our Partner, Simon Wong, and Trainee Solicitor, Sera Cheng, discuss a recent Court of First Instance decision in Global Mining Development L.P. & Gerald Metals LLC v China National Gold Group (Hong Kong) Ltd.

This landmark judgment addresses increasingly common tactics in high-value, cross-border disputes, including attempts to delay enforcement of arbitral awards through fresh proceedings, parallel arbitrations, and newly framed allegations of fraud or bribery.

In firmly rejecting such approaches, the Court delivered a clear and timely message on the limits of re-arbitration and reaffirmed Hong Kong’s pro-enforcement stance. The decision underscores the central importance of arbitral finality and confirms the high threshold that parties must meet to resist enforcement in Hong Kong.
